Will Governor Protect 4th Amendment Rights?

When the Senate tucked tail and ran in the face of the Feds’ scare tactics, we decided to put some calls in to Texas households to see what voters thought about the TSA bill.

It should come as no surprise that Texans aren’t really fond of the TSA fondling travelers without a reason.  In fact, out of the more than 11,000 people that answered our call, almost 70% said that they agreed with the proposed bill to ban intrusive pat-down techniques that include “touching passengers inappropriately while going through security unless probable cause exists for the search.”

Texans are clearly tired of the government continuing to intrude in our lives.  A majority of Texans in every single Senate District that we called supports the efforts of our Legislature to stop these ridiculous and unnecessary searches.

And we weren’t just calling Republican activists or Democrats concerned with civil liberties either– our calls went to real Texans without regard for political affiliations. This clearly demonstrates what side of the issue voters on all sides of the political spectrum come down on.  Texans just don’t like the feds “touching our junk” without a reason. Republican and Democrat districts alike support the TSA groping pat-down ban.

A few examples:

- Sen. Tommy Williams (R) – SD 4 – 73% in favor
- Sen. Mario Gallegos, Jr. (D) – SD 6 – 72% in favor
- Sen. Dan Patrick (R) – SD 7 – 75% in favor
- Sen. Wendy Davis (D) – SD 10 – 69% in favor
- Sen. Kirk Watson (D) – SD 14 – 70% in favor
- Sen. John Whitmire (D) – SD 15 – 68% in favor
- Sen. Robert Duncan (R) – SD 28 – 73% in favor

It’s time that the Senate saddle up and listen to the voice of the people just like the House did by passing the bill unanimously on both floor votes during the regular session.

    Dear Debra, there’s a minor problem called the Federal Law that cannot be trumped by State law. No matter what is done at the state level, we are not going to affect the jurisdiction of the TSA at the airports across Texas. This is pointless political posturing in the state house. If there is a problem with the federal, the go seek relief in the US Congress with our congressmen and senators there! And stop vilifying men and women who are only doing what the law and TSA policy requires them to do.
    What’s your suggestion for improving the system?? Do you have a better idea? Do you have any understanding of what the effect of this law would be? What about a person obviously carrying something in their private area(s). They would get a pass with this law! Seriously? C’mon!! We can do better than this!!

      Dear SoberReality…wrong, you are quoting the S.O.S. that everyone quotes that have never challenged anything much less the Federal Governments intrusions. Do you really buy into the scare tactics of shutting down the Airspace for non existent terrorist. Please, grow some courage and at least act like your Fore Fathers who fought so valiantly for Texas in the past.

    Aaahh, but there’s also a U.S. Constitution and Bill of Rights. 4th amendment is specifically crafted to protect from this sort of search: ‘The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    This bill simply seeks to force the federal agents to comply with the U.S. Constitution
